Terms and conditions of sale

The services available on the website www.materiel-forain.fr are offered by Matériel Forain. To benefit from the services provided by Matériel Forain, we ask you to carefully read these general terms and conditions of sale and use.

Ordering services is reserved for users who have read these General Terms and Conditions in their entirety prior to placing an order and have accepted them without reservation; any order implies full and complete acceptance of these General Terms and Conditions. Matériel Forain reserves the right to modify these General Terms and Conditions at any time without prior notice, it being understood that such modifications shall not apply to orders previously accepted by Matériel Forain. It is therefore essential that you review and accept the General Terms and Conditions at the time you place your order, particularly to ensure you are aware of the terms applicable at that time. These General Terms and Conditions are effective as of May 1, 2007. This edition cancels and replaces all previous versions.

Orders

You can place an order online. No order cancellation will be accepted once the package has been shipped. If the cancellation occurs before shipment, it will result in a compensation fee set at 10% of the total order amount including tax, and any deposits paid will be retained. HBE DISTRIBUTION reserves the right to cancel or refuse any order from a customer with whom there is an existing dispute regarding payment for a previous order. INTERNET: Please note that all your payment information is encrypted and secured by PayPal. Our website will continue to evolve over time, and you will find the full range of products offered by Matériel Forain.

PHONE / CHECK / BANK TRANSFER: For efficiency and quality of service, you can also place your orders by phone. We accept all credit card payments as well as payments by check and bank transfer (your order will only be shipped once payment has been received). Our customer service is available from 9:00 AM to 7:00 PM, Monday through Friday.

Prices and price adjustments

The displayed prices are subject to change depending on current economic conditions: original prices, exchange rates, customs duties, VAT rates, and transportation costs. Price adjustments will not be specifically communicated to the buyer but will be directly reflected in the product page on the website. Prices are shown including taxes (TTC) in the currency of the respective country. Handling, packaging, and shipping fees are added to these prices.

Validity period of sales offers

Products are offered for sale while supplies last. For products in stock, our offers are valid subject to availability. HBE DISTRIBUTION grants a limited license for access to and use of the website. Under no circumstances is the user authorized to download or modify all or part of the website without the prior written and express consent of HBE DISTRIBUTION.

Order availability

Orders are always fulfilled subject to stock availability.

Customs duties

Any order placed on the website and delivered outside the EEC may be subject to taxes and customs duties that are applied when the package reaches its destination. These customs duties and potential taxes related to the delivery of an item are your responsibility and at your own expense. We are not required to verify or inform you of applicable customs duties and taxes. To find out about them, we recommend contacting the competent authorities in your country. We provide a tax refund form upon request for any shipment outside Europe.

Payment

You can make your payment by credit card, check, or bank transfer. Cards issued by banks outside France must be international bank cards. Payment by bank check is only possible for checks in euros drawn on a bank located in France, the French overseas territories, or Monaco. In all other cases, you may contact us to arrange a bank transfer.

The check must be made payable to HBE DISTRIBUTION and sent to the following address: HBE DISTRIBUTION, 90 avenue Victor Hugo - 93300 Aubervilliers. All purchases are payable at our company headquarters upon ordering the products.

Note: We remind you that our website allows you to make purchases and send us your order by selecting the “payment by check” option, should you wish to avoid paying by credit card. In this case, we will wait for your payment by mail, including your order number or printed copy of the order, as well as a photocopy of your ID card. We will use your phone number or email address to contact you if necessary.

Shipping

Shipping costs are always the responsibility of the buyer, except in cases of special promotional offers displayed on the website, where they may be partially or fully covered by Matériel Forain. Shipments within the European Community or neighboring countries are at the buyer’s expense under the conditions specified on the electronic order form, or within the limits of partial coverage under promotional conditions applicable to the French territory by Matériel Forain. Shipments to French overseas territories (DOM-TOM) are at the buyer’s expense under the conditions specified on the order form, or within the limits of partial coverage under promotional conditions applicable to the French territory by Matériel Forain. For any other destination, please contact us. The buyer agrees to check the condition of the product upon receipt and to make any necessary claims to the carrier in the event of a serious or confirmed issue. To be valid, any complaint must be received by Matériel Forain no later than three days after the delivery date of the goods. The sooner, the better.

Delivery time & Product availability

We keep almost all of the listed products in stock. Delivery dates are provided in good faith but without commitment on our part. If the order is delivered within 30 working days, the customer is required to accept the goods. In case of refusal, return costs will remain at the buyer’s expense. We will not accept any penalties or claims for compensation. However, order cancellation due to delay will be accepted only after exceeding thirty working days.

Retention of Ownership

In accordance with Law No. 80.335 of May 12, 1980, and the Law of January 25, 1985: The equipment and supplies sold remain the property of HBE DISTRIBUTION until full payment of the price. It must be clearly understood that the buyer fully accepts this retention of ownership clause from the first commercial transaction, without the need to restate its content for each delivery, and for the entire duration of our future contractual relationship.

Returns

Any defective item will be exchanged free of charge if you report the issue within 7 working days. The buyer is responsible for the careful packaging and return shipping costs of the product in question, while Matériel Forain covers the cost of the second delivery.
